As per Spet 2009 visa bulletin, my PD will be current . I recently moved to LA due to Job change . If i do AC 21, do you think i will miss a oppurtunity of getting GC in spet since my PD is OCT 2004.
Please advise. Should i do AC21 now ? Or Should i do only on RFE?
Another question. I still have permanent address in chicago but moved to LA. Do i need to do AC11 form?

Hello everybody,
My wife who is on H4 was denied admission to a masters in accounting program due to lack of work experience. Other factors (GPA/GMAT scores) were allright according to a professor at the university! Does anybody know how/where she can get some experience (voluntary/unpaid/intership). We have already looked at craigslist job listing in the non-profit sector and not many people are looking to hire even if its unpaid:eek: We reside in Raleigh/NC and was wondering if someone in this forum has some insight as to how we can move forward.

Follow-to-join can be applied anytime after the filing of I-485 even after approval as long as Visa Number is available at the time of filing. Visa number's availability depends on the Department of State's Visa Bulletin.

Friends,
I have had my GC for about two and a half months now. I am currently checking out SOA consultant positions with a consultancy in Saudi Arabia. I don't know the length of the contracts yet. Can I work out of USA and still apply for Citizenship after the wait of 4 years and 9 months ? Does this require me to stay a certain amount of time in USA for every year ? What are the tax implications ? Would I have to file taxes on the income that I earned out of USA ? Thank you.

I am sure you would not have asked this question if use the term Permanent Resident instead of GC. I believe they ask you to follow the above requirements just to contribute to American Economy by providing your expertise and Tax money...

Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

All this big companies as declared will reduce h1b employees in us and will do work remotely - so payroll reduction will be in us and ultimately more loss to us goverment.
if they reduce even 4 out 10 than also 6 people government will get $12k while additional 4 govt. will loose atleast tax and social security other together more than 50k and all the expenses they will do here all those money will go out of the country rather than spending done here, so many side impacts to other industries.

I don't think anybody ask for an EVL at POE! And even if they ask, there are no 'format' requirements. If you want, you can just take a standard EVL mentioning your salary, duration of work and title - that should be it.

I'm coming to the US for the first time on H1B. Do I need a one way or a return ticket? My travel agent told me that since I have a multiple entry visa (expiring on Oct 2011) a return ticket is not required unless I need to travel back home within one year. Could someone with knowledge about this issue help me out. I would really appreciate a reply from someone who recently landed in the US on H1B.

Hi there,
One of my friend who just finished his masters and in process of getting his OPT in hand, also he is planning to file his H1B visa in 2010.
While his status in OPT he got an oppertunity to own a corporation, my questions to you all as follows.....
1. Can he own a coroporation while his status on OPT? I know one can own a corporation if his/her status is on H1B.
2. If he own corporation with his current status (OPT) and if he files his H1B in year 2010; what issue might he face?
3. Are there any legal obligations to own a corporation while his status on OPT? Or does he require to take any extra measures / precautions to own this coporation?
Note: He just wants own this company and not plan to do anything much to it until he settles down and he wanted utilize this oppertunity.
I would really appreciate your answers.....

1) Got laid off from company A (they haven't cancelled my H1).
2) Got my H1B transferred to company B (this H1B transfer has not yet been approved). I did not work for them.
3) I did premium processing for H1B transfer for company C and got it approved. I haven't started working for them.
4) Now I have decided to work for company D. They are ready to do my H1B transfer.
Will that be a problem or do I have to go with company C? I do not have paystubs from company B and C. If I have to reenter US, will that be a problem? Please help me out.
file it immediately and start working for C. If there is an RFE, it'd take few months by that time you just send ur current pay stubs. INS is generally flexible for a month or so..act fast

I and the lawyer studio failed the first request for a VISA. I didn't like their way to work and all the money they asked ( 12000 USD for nothing) so I am looking for alternatives.
Is it my right to have back FOR FREE all the documentation they have collected ?
